Massachusetts employers are required to pay employees at least the state minimum wage of $15.00 per hour for all hours worked up to 40 hours per week and are required to pay non-exempt employees time and a half for all hours worked in excess of forty hours per week. Until January 1, 2023, most employers were required to pay premium pay for all hours worked on Sundays. Most workers in Massachusetts are also entitled to 40 hours per year of paid sick time. Employers must pay earned wages within 6 or 7 days of the end of the pay period. If an employee is fired, the employer must pay all compensation owed to them on the day they are fired.

Massachusetts law requires strict compliance when it comes to employee wages – paying compensation even one day late is a violation, and an employer who violates the law will be required to pay triple damages, court costs and attorney fees.

The statute of limitations to bring a claim for wage act violations is three years. If you have questions about whether your rights under the wage act may have been violated, call us for a free consultation.
