Appeals Court: Market Value Entails Development Potential, Massachusetts Lawyers Weekly
To meet its duty of good faith and reasonable diligence, a foreclosing mortgagee must consider the property’s development potential when ascertaining its fair market value, the Appeals Court has decided.
In Property Acquisition Group, LLC v Ivester, et al., the now-former property owners asserted that a mortgagee that admitted it had not obtained any appraisals, evaluations, or expert opinions to determine the value of the property prior to the auction had not adequately protected their interests in the foreclosure process. Illinois lawyer, payday lender can be sued in Massachusetts, Massachusetts Lawyers Weekly
A debt collection attorney and payday lender from Illinois had sufficient minimum contacts with Massachusetts for the exercise of personal jurisdiction of consumer protection claims by a borrower who lives in Roslindale, a U.S. District Court judge has determined.
With respect to the defendant attorney, George Wahbeh, Judge William G. Young found jurisdiction could be based on a single letter sent to the plaintiff’s work email account in Massachusetts for the purpose of garnishing her wages. READ MORE HERE
