RoundPoint Mortgage Servicing Accused of Violating the Rights of Massachusetts Homeowners/Mortgagors
After an investigation, the Massachusetts Attorney General alleged that RoundPoint Mortgage Servicing (“RoundPoint”) committed unfair mortgage servicing practices, violating Massachusetts law, G.L. c. 244, § 35B, by failing to properly review borrowers who were behind on mortgage payments for available loan modifications that would have brought their loan current and avoided foreclosure, and violated Massachusetts debt collection regulations by failing to timely issue compliant debt validation notices and by calling borrowers more frequently than the law allows.
To avoid litigation, RoundPoint paid $975,000 and filed an “Assurance of Discontinuance” of its alleged violative practices on December 22, 2022 in Suffolk Superior Court.
